Terms of use

These terms are a contract between you and Vero Payments Solutions Ltda (CNPJ 29.755.203/0001-70), São Paulo, Brazil, the company that operates Influmaker ("we", "us"). They cover the website, the Studio, the API and the MCP server (the "service"). By creating an account or using the service, you agree to them and to our privacy policy.

1. Your account

You must be at least 18 years old and give accurate information.
You are responsible for your password, your API keys and everything done with them. Tell us right away if you suspect misuse.
If you use Influmaker for a company, you confirm you can bind that company to these terms.

2. Balance and payments

The service is prepaid. You add balance and each generation is charged at the price shown before you run it.
Generations that fail are not charged; any amount held for them is returned to your balance.
You may cancel a purchase within 7 days and get a refund of the unused part of that balance, as the Brazilian Consumer Defense Code (art. 49) allows. After that, balance is not refundable, except where the law requires otherwise.
We may change prices; changes never apply to generations already started.

3. Your content

You keep all rights you have to what you upload and, as between you and us, you own the outputs you generate, including for commercial use.
You give us a limited license to store, process and show your content only to run the service for you.
Outputs come from AI models: they may be inaccurate or similar to other people's outputs, and some countries may not grant copyright to AI-generated works. Review outputs before you publish them.
You must have all rights and consents needed for what you upload, including the image and voice of any person shown.

4. What you must not do

Create sexual content involving minors, or anything that sexualizes minors. We report it to the authorities.
Create intimate or sexual images of real people without their consent.
Impersonate real people, or create deepfakes meant to deceive, defraud, harass or defame.
Create misleading political content, or present AI content as real in a way that could harm people.
Infringe copyright, trademarks or other rights, or advertise without labeling AI content where the law or the platform requires it.
Promote violence, hate, terrorism or illegal activity, or break the law in any way.
Abuse the service: bypass limits or moderation, resell access without our written permission, or attack, scrape or overload our systems.

We moderate prompts and uploads and may block requests, remove content, or suspend accounts that break these rules.

5. API and MCP

API and MCP usage is billed like Studio usage and is subject to rate limits. Keep your API keys secret; we are not responsible for charges made with a key you exposed.

6. Availability and changes

We work to keep the service available but do not guarantee it will be uninterrupted. Models come from third parties and may change or be removed. We may update the service and these terms; we will email you about material changes, and continuing to use the service means you accept them.

7. Ending your account

You can close your account at any time. We may suspend or close it if you break these terms or the law. After closing, you can ask for a refund of unused balance, except when the account was closed for breaking these terms.

8. Liability

The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential damages, lost profits or data, or for how you use outputs, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing here limits rights that consumers have under Brazilian law.

You agree to cover us for claims caused by your content or by your breach of these terms.

9. Law and courts

These terms are governed by the laws of Brazil. Disputes go to the courts of the city of São Paulo, SP, except that consumers may always sue in the courts of their own domicile.
